Manage AI transparency disclosure

Automatically show leads when they're talking to AI, and control disclosure for organizations outside regulated regions.

If your AI Sales Agent doesn't disclose that it's AI, your organization risks violating laws such as the EU AI Act and California's AI Transparency Act (CAITA), which can result in fines or forced retroactive disclosures. AI disclosure automatically adds a clear AI identity statement to every new chat session and outbound email your AI Sales Agent sends, so you stay compliant without configuring anything yourself.

Disclosure is part of your AI Hub settings and applies across both channels your AI Sales Agent uses: chat and email. It works alongside your agent's Base Guidance and Response Guidelines, but doesn't change how the agent answers or qualifies leads, only what it discloses at the start of the conversation.

How AI disclosure works

Every new chat session and outbound email from your AI Sales Agent opens with a clear AI identity statement, before any other content reaches the lead. Disclosure is on by default for every organization.

Important: If your organization operates in the European Union, you can't turn off AI disclosure. The opt-out capability isn't available for EU accounts, so disclosure remains on regardless of any other settings.

Organizations outside the EU can turn disclosure off if they qualify for the opt-out SKU. Doing so shifts responsibility for compliance with laws in any regulated region their leads are based in onto the organization. Everywhere else, the default stays in place until you change it.


Preview AI disclosure in chat and email

In the chat, disclosure appears twice. Before opening a conversation, the pre-chat form displays "An AI assistant greets you first" under the Start Chat button. Once the lead starts chatting, the conversation opens with a "Connected to AI Assistant" banner above the agent's first message.

In email, the AI identity statement appears once, in the footer of every outbound message, below the signature block: "This message was sent by an AI assistant".


Turn off AI disclosure

Turning it off is available only if you qualify for the opt-out SKU, and it comes with a tradeoff you accept at the moment you turn it off.

Important: Turning off AI disclosure shifts responsibility for compliance with AI transparency laws, such as the EU AI Act and CAITA, onto your organization in any regulated region where your leads are based. Confirm none of your leads are based in the EU or California before you continue.

Turning off AI disclosure removes the AI identity statement from new chat sessions and outbound emails. Organizations operating in the European Union won't see this option, since the opt-out SKU isn't available there.

  1. Go to AI Hub > Settings.

  2. Clear the AI Disclosure checkbox.

  3. Click Save Changes.

  4. In the dialog, confirm the following: "I confirm the outputs of this AI system will not be used for members that reside within the European Union or the State of California, and I accept liability for non-compliance with applicable AI transparency laws such as the EU AI Act, CAITA, etc."

The change applies immediately. Any chat session or email started after you turn off disclosure won't include the AI identity statement.


Turn AI disclosure back on

You can reverse this at any time, whether your organization was grandfathered in with disclosure off or you turned it off yourself.

  1. Go to AI Hub > Settings.

  2. Select the AI Disclosure checkbox.

  3. Click Save Changes.

The change applies immediately. Any chat session or email started after you turn on disclosure includes the AI identity statement again.


Best practices

These aren't required steps, but they'll help you decide when turning off disclosure makes sense.

  • If your organization has leads across multiple regions, only turn off AI disclosure if you're confident none of them are based in the EU or California. The confirmation checkbox makes your organization responsible for that distinction going forward.

  • If you're unsure whether turning off disclosure affects your compliance obligations, leave it on. It doesn't change how your AI Sales Agent answers or qualifies leads, only what it discloses at the start of the conversation.


FAQs

Why can't I turn off AI disclosure for my organization?

You can't turn off AI disclosure because your organization's account doesn't include the opt-out SKU, which isn't available for organizations operating in the European Union. Disclosure stays on for these organizations regardless of any other setting.

Will my leads notice anything different if I turn off AI disclosure?

Leads won't see the AI identity statement in chat or email if you turn off AI disclosure. Your AI Sales Agent otherwise behaves the same: disclosure only controls whether that statement appears.

What happens if my organization starts getting leads from the EU or California after I've turned off disclosure?

Turning off disclosure once doesn't cover you permanently. The confirmation checkbox makes your organization responsible for checking this on an ongoing basis, not just at the moment you opted out. If any of your leads could now be based in a regulated region, turn AI disclosure back on to stay compliant.
